Mental Capacity Act & Deprivation of Liberty Safeguards Awareness course


 

 

Description

 

This awareness course has been designed to provide learners with an overview of the Mental Capacity Act 2005 and Deprivation of Liberty Safeguards (DoLS) and the implications they have for the service user and service provider. The aims of this course are to teach delegates what is meant by mental capacity and the five core principles of  the MCA. Delegates will be able to define deprivation of liberty and understand the current assessment and authorisation process.


The Mental Capacity (Amendment) Act 2019 received Royal Assent on 16 May 2019 and has now become law. The purpose of this amendment is to abolish the Deprivation of Liberty Safeguards (DoLS) and replace it with a new system called the Liberty Protection Safeguards (LPS). The government is currently working on the LPS code of practice to be presented to Parliament by Spring 2020. A number of regulations will also need to be drafted before the legislation can be implemented. The intention is that LPS will be implemented from 1 October 2020. The current situation is that there will be a 12 month overlap, with the LPS and the DoLS being used simultaneously until September 2021 to enable those subject to DoLS to be transferred to LPS in a managed way or allow their DoLS to expire at their set expiry date subject of course to any change in the person’s circumstances that would mean it needs to be ended earlier. This course will provide infromation about the current system of DoLS and also about key points of the incoming LPS system which will replace it.

Important Information

 

Please note that the candidates should have satisfactory English literacy and numeracy skills to understand the course and to complete any assessments.

 

  • The training room should be quiet and of appropriate size.
  • Staff should be off work and not expected to be on duty.
  • Staff attending should remain on the course for the entire duration of the training course.
